Terms of use

This English version is a translation provided for convenience. The French version is the binding one and prevails in case of discrepancy.
1. Purpose
These terms of use (the "Terms") govern access to and use of the Sweengs application (the "Service"). Creating an account constitutes full acceptance of the Terms.
2. Nature of the Service: no investment advice
Sweengs is an educational and informational tool that assists with the analysis of equity markets (momentum screening, backtests, simulations, algorithmic signals, learning content).
- The Service provides no investment advice within the meaning of Article D. 321-1 of the French Monetary and Financial Code and of the MiFID II directive, and no personalised recommendation to buy or sell financial instruments.
- The publisher is neither an investment services provider nor a financial investment adviser and is not licensed by the AMF or the ACPR (the French financial regulators).
- Signals, scores and simulations are generated automatically by algorithms, without regard to your personal situation, objectives or risk tolerance.
- Past or simulated (backtested) performance is no guarantee of future performance.
3. Risks
Investing in financial instruments carries a risk of capital loss that may be total. The user is solely responsible for their investment decisions and declares that they have the necessary knowledge, or undertakes to consult a licensed financial adviser before any decision.
4. User account
- Registration requires a valid e-mail address. One account per person.
- The user is responsible for keeping their credentials confidential.
- The publisher may suspend or delete an account in case of breach of the Terms or fraudulent or abusive use (scraping, resale of data, overloading the Service).
5. Market data and availability
- Data comes from third-party sources (Financial Modeling Prep, Twelve Data) and is provided without any warranty of accuracy, completeness or real-time delivery (quotes may be delayed).
- The Service is provided "as is", without any warranty of continuous availability. Interruptions (maintenance, incidents, third-party dependencies) may occur, in particular during the beta phase.
6. Beta phase
The Service is currently in beta: features may be changed, suspended or removed without notice, and defects (calculations, displays, signals) may remain. The user is aware of this and accepts these limitations.
7. Limitation of liability
To the extent permitted by law, the publisher shall not be held liable for:
- financial losses, lost profits or damages resulting from investment decisions taken by the user, including on the basis of signals, backtests or content of the Service;
- errors, delays or unavailability of third-party market data;
- interruptions of the Service or loss of data due to force majeure or the act of a third party.
8. Intellectual property
The Service, its code, interfaces and content remain the exclusive property of the publisher. The user is granted a personal, non-exclusive and non-transferable right of use. Any bulk data extraction, reverse engineering or resale is prohibited.
9. Personal data
The processing of personal data is described in the Privacy policy.
10. Subscription, prices and billing
- The Service has a free tier and a paid tier, whose price is displayed on the Pricing page before any subscription.
- The subscription is taken monthly or yearly and renews automatically at the end of each period unless cancelled.
- Payment is processed by Stripe. The publisher neither collects nor stores any card details.
- The user may cancel at any time from their billing area. Cancellation takes effect at the end of the current period, which remains due.
- The publisher may change its prices. Any increase is notified at least thirty days before it takes effect, applies only from the next renewal, and the user may cancel free of charge until then.
- Prices are in euros. The publisher benefits from the French VAT exemption for small businesses (Article 293 B of the French General Tax Code): invoices are issued without VAT. Should this regime cease to apply, VAT is added to the displayed price and the user is informed with the same notice as for a price increase.
11. Right of withdrawal
Consumers have fourteen days from subscription to withdraw, in accordance with Article L. 221-18 of the French Consumer Code.
By requesting immediate access to the Service, the user expressly requests that performance begins before the end of this period and acknowledges that they lose their right of withdrawal once the Service has been fully performed (Article L. 221-25). 12. Transparency commitments
The following commitments are not marketing: they are contractual and enforceable against the publisher.
- Publish rejected research. Every strategy tested and then discarded is published with its method, its sample size and the date of its verdict, including when the result calls into question a rule the publisher had itself deployed.
- Publish the gap between backtest and reality. For each active strategy, the difference between what the backtest announced and what the strategy delivers in live conditions is published and kept up to date.
- Publish the track record without selection. Signal performance is published in R, losses included, over the entire period tracked, with no choice of which trades are shown. It can be consulted without an account at app.sweengs.com/resultats.
- Never charge for the absence of a result. A scan that returns no signal is not deducted from the user's quota.
13. Changes to the Terms
The publisher may change the Terms at any time. Users will be informed of substantial changes by in-app notification or e-mail. Continued use constitutes acceptance of the amended Terms.
14. Governing law
The Terms are governed by French law. Failing an amicable settlement, any dispute falls under the jurisdiction of the competent courts under ordinary law. In accordance with Articles L. 612-1 et seq. of the French Consumer Code, consumers may use a consumer mediator free of charge.
